("CAMPER", "we", "our", "us"), incorporated in accordance with the laws of Spain, with its registered seat at Poligono Industrial s/n, 07300 Inca (Mallorca), Islas Baleares, Spain, entered into the Palma de Mallorca commercial register, tax identification number B07099047.

This website and any services connected with it are made available to the Customer in accordance with the Terms and Conditions below (the "Terms and Conditions") as well as other rules which can be found on our website. Prior to placing an order via this website, please read these Terms and Conditions carefully. We recommend retaining a copy of these Terms and Conditions for future reference. By entering and making use of this website, the Customer agrees to these Terms and Conditions, including any subsequent amendments. If the Customer does not agree to these Terms and Conditions they should stop using and leave this website. Certain campaigns, special offers, or competitions may be subject to separate terms and conditions. A Customer wishing to participate in such a campaign, special offer or competition should agree to the terms and conditions of the campaign, special offer or competition in question. In the event of any discrepancies between those terms and conditions and these Terms and Conditions, these Terms and Conditions prevail.

We would like to bring to Customer's attention in particular the conditions with respect to making purchases which can be found in these Terms and Conditions and our Privacy Policy. A Customer under 18 years of age must inform their parents or guardians of these Terms and Conditions and of the CAMPER Privacy Policy, and parents or guardians must tick the consent box for these Terms and Conditions and the Privacy Policy before the Customer registers to use this website or services of any kind which are available on the website. We do not accept orders from persons under 18 years of age.

CAMPER reserves the right to amend, modify or replace parts of or the whole of this website, as well as information and materials on this website, and also these Terms and Conditions. Please return to these Terms and Conditions from time to time in order to review any amendments or modifications.

Registration

In order to make use of certain services and functions available to Customers on this website, a Customer is required to register. As of the moment of registration, a Customer is required to provide details about themselves which are true, precise, up to date, and complete in every regard. In the event of changes to any data given during registration, a Customer is required to notify us promptly by e-mailing us at customercare@camper.com. A Customer may wish to review our Privacy Policy. We may amend the registration requirements from time to time.

Right to make purchases

In order to make purchases using this website, a Customer is required to give personal data. In particular, a Customer is required to state their true first name and surname, telephone number, e-mail address, and other information. When placing orders for products, a Customer is also required to provide payment details; the Customer also declares and warrants that the payment details given when placing an order are both up to date and true, and confirms that they are the person specified in the information given for the purpose of processing payment.

By placing an offer to purchase our products, a Customer explicitly authorises us to perform a creditworthiness check and - where CAMPER deems it necessary - to forward to third parties or obtain from third parties from time to time information (and this includes any kind of updated information) regarding the Customer, including in particular their credit card number, for the purpose of authentication of the card, obtaining preliminary credit card authorisation, and authorising a transaction.

Personal data

Please be informed that under the Privacy Policy a Customer's personal data is placed in records for which the party responsible is Ruralmed, S.L., and which will be used for the purposes specified in the Privacy Policy referred to above. Please also be informed that a Customer's data is placed in records for which the party responsible is MONTUIRI sp. z o.o., which will be used for processing and delivery of a Customer's order. A Customer has the right to access, correct, and cancel the personal data, and this right can be exercised with respect to Ruralmed, S.L. or MONTUIRI sp. z o.o. by following the procedure specified in the Privacy Policy.

Purchase conditions

Goods

The products displayed on this website are only selected goods from the CAMPER catalogue. This selection has been made specially for the CAMPER online store. Availability of our products changes in real time, and this means that certain products might be out of stock. The CAMPER online store is not liable for absence of items of any model that is put on display.

Please note that our products change on a seasonal basis.

Please note that products placed in a Customer's shopping cart are not reserved and may be purchased by someone on the site.

How to buy goods

The procedure for making purchases in the CAMPER store is as follows:

A Customer should select the items they wish to purchase and place them in the shopping cart by clicking on the appropriate shopping cart icon which can be seen on the website.

The shopping cart will contain the reference codes, name, size, and price (including VAT) of the selected products.

In the shopping cart, we give a summary of the products to be purchased and their total value (including VAT and shipping costs).

Once products have been selected, a Customer is required to fill in the order form. Personal data and payment details necessary to process the order must be given on this form. Please bear in mind that all data must be completely accurate in order to avoid errors or problems with shipping the purchased products.

Order confirmation

 

Once selection has been made and an order placed, the Customer will receive an e-mail from CAMPER confirming that the order has been registered (order confirmation). The order confirmation states among other things the item ordered, the total price (including VAT and shipping costs), and the shipping details.

 

If a Customer makes an error when placing an order they should contact the customer service department, who will be pleased to assist. We ask however that orders always be checked before submission. Before placing an order, a Customer has an opportunity to edit all of the information given, such as the shipping address or details for processing payment, or credit card details, and also to change or delete the items in the shopping cart.

E-mails might not reach the addressee in cases of temporary technical problems or typos in e-mail addresses. In either of these cases, please contact our customer service department at customercare@camper.com. We reserve the right not to accept an order placed by a Customer if - for example, we are not able to obtain payment authorisation, a particular item is subject to shipping restrictions, or a product is not available. A Customer will be notified by e-mail if the items ordered are not available, and if payment has been processed, all amounts will be refunded.

 

We cannot be liable towards a Customer or third parties for the following: withdrawal of a product from the website regardless of whether a particular product has been sold; deletion, scanning, or editing of materials or content featured on the website; refusal to process a transaction.

Pricing policy

The prices given on this website are given in EUR or PLN and include all applicable taxes unless explicitly stated otherwise. All prices and offers are valid according to information given from time to time. The price displayed on the website with regard to a product at the moment an order is placed is binding. CAMPER shall not be liable for any additional taxes, customs duties, or additional costs related to shipping. CAMPER reserves the right to alter retail prices at any time. This does not apply to orders that have been placed.

Payment methods and security

We accept orders at any time, 24 hours a day, any day of the week.

CAMPER only accepts payment by credit card or debit card, via electronic payment systems, upon delivery, or where available by bank transfer, as described in detail on the payment page, and accepts payment by PayPal and on delivery depending on the country of destination. Payment methods not listed above are not accepted.

The Customer confirms that a credit card or debit card used belongs to them or that they have obtained explicit authorisation from the owner of the debit or credit card to use the card. All holders of credit or debit cards are subject to authentication and authorisation by the card issuer. If the issuer of the Customer's card refuses to authorise payment to CAMPER, CAMPER shall not be liable for delays or non-delivery.

We make every effort to ensure that this website is secure. In order to make sure that payment transactions are kept secure, CAMPER uses a secure payment system, which means that all confidential details (such as the number of the credit card and card expiry date) are encoded and sent on directly using SSL technology, on a secure server.

We take all the possible measures available to us to keep a Customer's order and payment details secure, but in cases in which no negligence occurs on our part we shall not be liable for losses that a Customer may incur if a third party gains unauthorised access to data provided by the Customer while using this website or placing an order on this website.

CAMPER shall not be liable for delays in delivery of goods caused by non-authorisation by a bank.

We dispatch orders from several locations. Orders with multiple products may be split to expedite delivery. In such cases, we will inform you via email.

CAMPER reserves the right to stop an order for security reasons. Affected Customers shall be notified. We also reserve the right to cancel an order if we are not able to authenticate the delivery and/or payment processing details, but in such a case we will notify the Customer of that fact. We also reserve the right not to accept and/or cancel an order if we ascertain that the purchasing Customer intends to sell the ordered goods on.

Sale limit

Customers wishing to purchase more than 5 pairs of shoes should contact the CAMPER online store customer service department, where they will receive detailed information about the possibility of making the purchase.

Purchase guarantee

We are only able to complete an order if the shipping address is the Customer's place of residence or work in one of the countries listed on this site.

The items displayed on the website have been selected from the CAMPER collection and meet exactly the same quality and guarantee requirements as the items available at CAMPER high-street stores.

The following detailed information is provided with each product:

CAMPER makes every possible effort to ensure that colours of shoes displayed differ as little as possible from the true colours. However, the displayed shoe colour may differ depending on a Customer's computer screen settings. For this reason, CAMPER cannot guarantee that colours displayed on the Customer's screen reflect the original colours exactly.

Special offers, promotions, and discounts are valid up until the specified date or until stocks run out, whichever occurs first. Our shoes have a two-year guarantee for manufacturing defects, counted from the date of purchase.

Delivery and insurance

CAMPER insures every product for the duration of transportation until the moment of delivery to the address given by the Customer. All orders are delivered by international courier services.

Shipping time:

         Products currently in stock: between 24 and 72 hours.

         Products available at our central warehouses: 7 days. Usually sent within one week.

         Products are sent from Monday to Friday, excluding public holidays.

         The time needed for delivery is between 1 and 10 business days from the day of shipping.

 

Deliveries are made to an address which is the Customer's place of residence or work in one of the countries listed on this site. A signature confirming receipt is required for each shipment delivered. As of the moment the order is signed for, responsibility for the ordered items passes to the Customer. We do not deliver items to post office boxes. Deliveries may also be made to stores managed by MONTUIRI sp. z o.o. A list of addresses of our stores in Poland can be found here.

Deliveries are not made on Saturdays and Sundays and public holidays in the region and country in question. All products purchased from CAMPER are delivered using recognised international courier services.

In order to avoid shipping problems (incorrect address, absence of recipient at the specified address) please make sure that the relevant form has been filled in properly, especially the box containing the telephone number.

When a Customer's order leaves the warehouse, the Customer receives an e-mail giving the shipment tracking number assigned by the courier service responsible for delivering the order. This enables the Customer to track the order. If a Customer has ordered more than one pair of shoes, we wait with shipment until all of the items are available because we only allow one shipment per order.

All items delivered by CAMPER remain the property of CAMPER until CAMPER receives payment.

Cancelling an order

A Customer may cancel an order at any time prior to shipping, and in such a case shall receive a full refund. If the goods ordered by the Customer have already been shipped out (i.e. they have left our warehouse), a Customer should wait with cancellation until the ordered goods are delivered. Please note that each cancellation of this kind is subject to specific conditions (see "returns and exchange").

In order to cancel an order before shipping, go to "my order" and type in the order number and e-mail address used to place the order. The details of the order will appear, and if the "anuluj/cancel" option is available, the Customer can click on this option to cancel the order. If this option is not available this means that the Customer's order has left our warehouse and cannot be cancelled. It is possible however for the delivered order to be returned in accordance with the product return policy.

In order to cancel an order, a Customer can also call the customer service department, unless the ordered goods have been shipped out.

 

Returns and exchange

 

If a Customer is dissatisfied with an order which has been received they can return or exchange the goods within up to 30 days of the date of receipt. In order to return or exchange a product, the product must fulfil the following conditions:

         The product must be unused.

         The product must be returned in the same condition in which it was sent and where possible be in the original packaging. If the original packaging is not available it must be replaced with packaging of similar dimensions and volume.

        The product must be delivered to our offices (see address below) within 30 days of the date on which the order is received by the Customer.

CAMPER does not allow exchange of products in general stores which sell CAMPER products. Also, CAMPER does not allow return of CAMPER products purchased in a high-street store or general store selling CAMPER products to the online CAMPER store.

It is best to place products which are sent to be exchanged or returned in the original packaging and send them by regular post with confirmation of receipt to the address given below (this also applies to the return procedure). A Customer may send items via a courier of their choice or the courier made available by Camper; if the Customer exercises the latter option, it is sufficient to follow the procedure described at http://www.camper.com/int/at_cliente_faq.xhtml?tit=4, and the courier will collect the shipment from the home of the Customer (the Customer should check whether that this service is available in their country here http://www.camper.com/int/at_cliente_faq.xhtml?tit=4).

Returns and exchanges can be made via our online store by sending products to this address:

Returns

In order to return an item please follow this procedure:

         Go to "my orders" and type in the order number and e-mail address used to place the order.

         The details of the order and the "return" option will appear. Click on this option and select the model you wish to return.

Once CAMPER has received the items and determined that they meet the conditions specified above, it will refund the Customer the amount paid for the items. If a request is submitted for a return within 14 days from the date of receipt of the products, CAMPER will refund the costs of the original delivery. Due to the fact that CAMPER applies longer return periods (30 days), if the Customer wishes to return an item after 14 days but before 30 days have passed from the day of receipt, CAMPER is entitled to deduct the costs of the original delivery. The direct costs of returning items are covered by the Customer, except in cases of manufacturing defects or defects in quality. In such a case, CAMPER is responsible for the cost of returning the items.

A Customer may exercise their right of withdrawal by sending us the relevant form located here, or by contacting our customer service department.

If a product is being returned due to a manufacturing defect or defect in quality for which CAMPER is responsible, we will refund the entire amount paid within 10 business days. The refund is made automatically to the credit card or account specified by the Customer, depending on the method of payment chosen by the Customer.

It is not possible for a Customer to return an order by way of a shipment to CAMPER payable upon delivery.

Exchange

In order to request a change of size or model, please follow this procedure:

         Go to "my orders" and type in the order number and e-mail address used to place the order.

         The details of the order and the "exchange" option will appear. Click on this option and select the model you wish to exchange.

In cases of exchange of products, the entire cost of shipping and collection of the order will be payable by the Customer making the purchase. It is not possible for a Customer to return an order by way of a shipment to CAMPER payable upon delivery.

When products which are to be exchanged reach us we will send the Customer a different size or model free or charge, using the same form of shipment as that used in the original order.

If a Customer wishes to obtain special benefits and customised service, they can set up "my account" here. Benefits and services of this kind, which are described in detail here, may change from time to time due to the product range or promotions available to the Customer being updated.

All intellectual property rights (including copyright, patents, trademarks, trade names, rights to databases and rights to patterns) to all information and materials (including a word logo, graphics, and software) displayed via this website are the property of CAMPER or CAMPER affiliates, or are used with the consent of the relevant rightholders and are explicitly reserved.

Use of this website and the contents of this website by a Customer does not mean that any kind of copyright, rights to patterns, trademarks or other intellectual property rights to the Content (as described in the section "Content" below) are given to or pass to the Customer, including rights to CAMPER software and any HTML codes and other codes on that website. The entire Content, including trademarks, patterns, and related third-party intellectual property rights mentioned or displayed on this site, is protected under national legislation on intellectual property, other provisions of law, and international treaties.

A Customer may use Content solely in accordance with explicit authorisation given by CAMPER and/or CAMPER's external licensors. The reproduction and redistribution of the Content described above is prohibited and can lead to civil and criminal penalties. Without prejudice to the provisions above, the copying and use of the materials described above on a different server or in a different location, or measures taken to publish, reproduce or distribute the materials described above, is explicitly prohibited. A Customer is however entitled to make one copy to display the Content for personal use.

Content

In addition to the intellectual property rights described above, "Content" is defined as any graphics or photographs, including rights to pictures, sounds, music, video recordings, audio recordings, or text featured on that site. Despite taking measures to ensure that information and materials on the website are exact, CAMPER does not guarantee that the Content on the website is up to date, complete, and precise, or that the Content does not contain defects, errors, and/or viruses. CAMPER also does not guarantee that such defects, errors, and/or viruses will be repaired or removed. CAMPER also reserves the right to stop access to the site in order to perform maintenance or upgrade work. We always recommend that all internet users have installed up-to-date anti-virus software.

Prohibited use for commercial purposes

This website is intended solely for personal and non-commercial use. A Customer may not modify, copy, disseminate, forward, display, replay, reproduce, publish, use for commercial purposes, transfer, or sell the Content, software, products, or services on this website, grant licences to the above, or produce derivative versions of the above. A Customer may not use the website or the Content of the website for commercial purposes, including for advertising or generation of revenue from advertising on their own website.

Actions on the part of a Customer

The Customer agrees that they are personally liable for use of this website and the whole communication and all operations that occur on and in relation to this website. If we find that a Customer has been involved in prohibited activities, demonstrated a lack of respect for other users, or breached the Terms and Conditions in some other way, we may refuse that person access to the website on a permanent or temporary basis.

Hyperlinks

We may place on this website hyperlinks to other websites or resources operated by third parties other than CAMPER, including advertisers. CAMPER has not reviewed all of the websites to which there are links on this website, and shall not be liable for the content and accuracy of external websites, or for availability of those external websites or resources. Limitation of liability

CAMPER shall not be liable under any circumstances for direct or indirect loss, damage, or expense - regardless of cause - which might result from use by a Customer of this website and/or information or materials on this website, or result from lack of availability of this website, or the fact that certain information or materials on this website are incorrect, incomplete, or out of date.

The clause above does not exclude or limit CAMPER's liability for issues for which liability cannot be excluded or limited by law.

Compensation

A Customer undertakes, upon a demand from us, to compensate us, indemnify us against, and waive liability in full, promptly and upon demand, including for our members of management, directors, representatives, affiliates, licensors, and suppliers, for any obligations, claims, expenses, damage, and loss, including costs of legal representation, resulting from breach by a Customer of these Terms and Conditions, including use of the website by another person and the obtaining by that person of access to a Customer's account as a result of action or omission on the part of the Customer.

Relationship between the parties

The Customer confirms and agrees that no relationship exists between the Customer and CAMPER of the nature of a joint venture, commercial partnership, employment, or representative office, which is provided for in these Terms and Conditions or resulting from use of this website by the Customer. The Customer acknowledges and understands that they may not, and undertake not to, present themselves as a representative, agent, or employee of CAMPER, and that CAMPER shall not be liable for any declaration, action, or omission on the part of the Customer.

Non-waiver of rights

In the event the Customer breaches provisions in these Terms and Conditions and we do not take action against the Customer, we will continue to be entitled to exercise our rights and make use of legal remedies in a different case of breach by the Customer of the Terms and Conditions.

Governing law

These Terms and Conditions are governed by and should be interpreted in accordance with the laws of Spain. Without waiving their own jurisdiction or jurisdiction to which they may be entitled by law, the parties agree to be subject to the jurisdiction of the proper courts of the municipality of Inca with regard to any statements of claim and claims which may arise in connection with implementation or interpretation of these Terms and Conditions.
